The purpose of this document is to regulate the GENERAL BOOKING TERMS AND CONDITIONS for SALLÉS HOTELS' online reservation services. The details of the company that owns this brand name are shown at the top of the document. The terms "You" and "User" are used here to refer to anybody accessing www.salleshotels.com (henceforward, the Website) for any reason or using the services provided through it.
The use of these services implies full acceptance, without reservation, of the validity of each one of the General Booking Terms and Conditions covered by the latest, updated version of these General Terms and Conditions.
As a Customer, you declare that you are of legal age and have sufficient legal capacity to be bound by these General Booking Terms and Conditions when entering into a contract with SALLÉS HOTELS.
SALLÉS HOTELS states that the processes to obtain the services offered are those that are described in these General Booking Terms and Conditions as well as others specified on-screen while moving around the Website, and you declare that you know and accept these processes as being necessary in order to enter into a contract for the services offered through the Website.
2. Use of SALLÉS HOTELS' online Reservation services
2.1. Online Reservation Services
2.1.1. Online Reservation Services: the online Reservation services are for reserving a room at any Sallés Hotels hotel. The use of these services implies the full acceptance, without reservation, and the validity of each and every one of the General Booking Terms and Conditions covered by the latest, updated version of these General Terms and Conditions.
2.1.2. Procedure for entering into a contract: when using the service, the User will receive a confirmation e-mail which will include his or her reservation booking number. That e-mail serves as proof of your reservation and confirmation of its acceptance. Please check the voucher and confirmation in order to avoid any possible misunderstanding. Should there be any incorrect detail or unacceptable term or condition, please contact us within two days of receiving the confirmation.
2.1.3. Guarantee and cancellation policy: reservations made through this website will be guaranteed by the credit card provided by the User when filling in the form. Failure to check-in or cancel before the cancellation deadline (up until 24 hours) means an automatic charge to the credit card of the amount corresponding to one night's stay as well as a cancellation of the reservation.

Reservations for more than 6 nights are guaranteed by paying 25% of the total amount for your stay. When this payment has been received, your reservation will be confirmed by e-mail. If you cancel your reservation between 7 days and 48 hours before your scheduled arrival date, 25% of the total amount for your stay will be charged. For long stays, confirmation deposits are not returned. If you cancel your reservation 48 hours or less before your scheduled arrival date, 100% of the total amount for your stay will be charged.
Our Reservations team will personally handle any cancellation request you may have, Monday to Friday from 9 am to 8 pm and Saturdays from 10 am to 3 pm on +34 972 65 23 63 or 24 hours a day at your destination hotel.
2.1.4. Prices per room and per night. The prices shown on our Website include VAT (sales tax).
2.2. Use of the services
The User commits to use the services in accordance with the law, morality, proper conduct and public order and these General Booking Terms and Conditions. As a consequence, Users must not use these services for purposes that are elicit and/or those that are contrary to these General Booking Terms and Conditions, are injurious to the rights and/or interests of third parties or which, in any way, may hurt SALLÉS HOTELS' services and/or its image.
2.3. Variations to the system
SALLÉS HOTELS is entitled, for greater flexibility and for the benefit of its Users, to unilaterally modify at any time and without prior notice the services it provides or the operational and technical Terms and Conditions and those relating to its services, by publishing such modifications at this Website in order to make Customers aware of them and so that they may accept them. Similarly, with the aim of improving the service and establishing an optimal level of quality, which is SALLÉS HOTELS' ultimate objective, Users may suggest modifications that they consider useful by contacting the Website managers via email@example.com .
2.4. Hotel categories
The hotel categories displayed follow the star system used in Spain and the number of stars for each hotel is determined by the different parameters that make up the official hotel classification system.
2.5 Rooms with two single beds (twin room) / double rooms
As our hotels normally have many more rooms with two single beds than double beds, sometimes a room with two single beds will be assigned even though the reservation was for a double room. If it is essential that your room has a double bed, we advice you to let us know and we will ensure that the hotel receives this information. At many of our destinations and hotels, double rooms have two single beds that are joined to make a double bed.
2.6 Reservations of 10 or more people count as group reservations
Normally, there are discounts and the hotel can apply certain conditions which will be clarified when making your reservation. Group reservations should not be divided into several smaller reservations. Payment and cancellation terms for group reservations will be confirmed along with each group reservation request.
2.7 Check-in and check-out times
Check-in from 2 p.m. offering room for a maximum at 4 p.m. The departure time is compulsory up to noon.
Payment for reservations is done when the reservation is made. Independently of whether or not confirmation vouchers have been issued, reservations may be cancelled where payment has not been received or if the Customer has a payment outstanding for any other, unrelated reservation.
Cancellations made more than 48 hours before the arrival date will incur a charge of xxxx a person and location. Cancellations made with less than 48 hours notice before the arrival date will be treated the same as if the guest had not arrived and the corresponding amount for the first night will be charged. For practical reasons, 48 hours means before 6 pm on the day prior to the day before arrival. On the following morning, the hotel will automatically free up rooms reserved by clients that have not arrived on the arrival date. Cancellations made outside of office hours must be sent directly to the hotel. For groups of 10 or more people, different cancellation terms will apply - these will be notified when the reservation is made. We reserve the right to cancel reservations which, due to appropriate reasons, we consider to be fraudulent.
2.10 Discounts for children
Children under two years of age stay free, in a cot, except where indicated to the contrary when making the reservation. Pricing policies relating to children vary from hotel to hotel. It is possible that, at check-out, the hotel will charge for breakfast for children aged two to 12 years where payment has not been made for accommodation. For children where payment of 50% of the adult price has been paid, breakfast is included. Children older than 12 years pay the same price as adults.
The destination hotel must be informed of minors less than 18 years travelling alone (or with friends of similar age) before making the reservation, and the hotel's approval is required before confirmation. Where the hotel is not advised of this in advance, it may be entitled to deny accommodation to minors less than 18 years of age who arrive without an accompanying adult.
2.11 In the highly unlikely event that the hotel is unable to provide the accommodation reserved, the Customer accepts that the hotel's responsibility is limited to finding accommodation of a similar level and offering suitable transport to that hotel. Sallés Hotels takes all necessary precautions to ensure that this does not happen and it is very rare. The Customer also accepts that advance warning of such a change of hotel cannot be guaranteed. The hotel shall not be responsible for costs, losses or damage arising from or related to relocation, since it does not have control over such a situation. If the Customer rejects a satisfactory alternative, it shall be at his or her cost and responsibility.
If the Customer is not satisfied with any aspect of the new hotel, he/she MUST make this known immediately to the management of the establishment, giving them the opportunity to rectify the situation from the start.
3. Protection of Users' personal data by SALLÉS HOTELS.
In compliance with article 5 of Law 15/1999 of 13 December on Data Protection, SALLÉS HOTELS hereby informs you that the personal data that you have provided to us when filling in any electronic registration form that appears on our Website, as well as any details that SALLÉS HOTELS may access as a result of your browsing, consultations, requests or contracting of any service or product or any transaction or operation carried out through SALLÉS HOTELS' Website, shall be kept in a file under the responsibility of EROLES SA, at registered company address (Polígono Industrial PAEC, parcela 4 17251 Calonge, Girona). Through that address, you may exercise your right to access, rectify, cancel and reject the processing of your personal data under the terms and conditions provided for in the Data Protection Law. Not filling in any of the obligatory fields on any of the electronic registration forms may mean that SALLÉS HOTELS is unable to deal with your request. The purposes for collecting your personal details are those that are specially indicated in each of the pages where the electronic registration form appears.
Generally, personal details that you provide us will be used to handle your information requests as well as inform you about new SALLÉS HOTELS activities, products and services. Your personal details may be segmented and processed in order to develop market profiles for advertising purposes. For the purposes of articles 11 and 34.e) on Data Protection, you expressly consent for your details to be communicated by SALLÉS HOTELS to Group companies, for the purposes previously indicated, to any country in the world including those that do not have a comparable level of Data Protection laws. By accepting this legal notice, you confirm that you are aware of article 27 of the Data Protection Law relating to the communication of this first granting of data.
Consent granted to communicate personal details can be revoked at any time; however this will not be retrospective. If, on completing your details in the corresponding form, you have stated your wish to receive information by e-mail, you likewise consent for us to send you promotional information by e-mail as required by the Law on Information Society and Electronic Commerce Services. In the event that you provide is with personal data relating to third parties, in compliance with article 5.4 of the Data Protection Law, you state that you have previously informed those persons about the content of the details provided, their origin, the existence and purpose of the file where there details are contained, the recipients of the information, the option of exercising their right to access, rectify, cancel or object as well as the identifying details of SALLÉS HOTELS, under the terms and conditions established here. SALLÉS HOTELS commits to handle your personal details with absolute confidentiality using them only for the purposes indicated.
SALLÉS HOTELS hereby informs you that it has in place the necessary technical and organisational security measures to guarantee the security of your personal details and to avoid them being altered or lost and to avoid unauthorised processing and/or access, taking account of the status of technology, the nature of the details stored and the risks to which they are exposed - whether due to human action or physical/natural means.
All of this is in accordance with article 9 of the Law on Data Protection and Royal Decree 994/1999 of 11 June through which the Regulation of security measures of computerised files containing personal details is approved.
4. Right to Modify the General Booking Terms and/or Conditions
SALLÉS HOTELS reserves the right unilaterally to modify, and without warning, any of the matters included in these General Booking Terms and Conditions in the manner that it deems appropriate, informing Users of the modifications made to the Website, so that they may be aware of them and accept them again.
5. Safeguarding the General Booking Terms and Conditions
If any of the stipulations in these General Reservation Terms and Conditions is declared null or ineffective, the rest shall remain under the terms agreed. None of the stipulations in this contract affect in any way the imperative provisions relating to consumers. If you are not a consumer, you expressly renounce your right to waiver.
6. www.salleshotels.com and acceptance of rules of use
The User is aware that the use of the online Reservation services implies full acceptance, without reservation, of each of the clauses that make up the Website Rules of Use, according to the version published by SALLÉS HOTELS at the moment when the Customer agrees to contract the service. These rules of use complete these General Terms and Conditions in all matters in which they are not in conflict with them. For this reason, Users should be aware of the importance of checking the rules on this page before accessing and/or using the services.
These Terms and Conditions are governed by Spanish legislation, which shall apply where not provided for under these terms and conditions with regards to their interpretation, validity and execution. SALLÉS HOTELS and the User - expressly renouncing all other jurisdiction - submit to the Courts and Tribunals of the registered office of SALLÉS HOTELS regarding any disagreement that may arise as a result of the provision of the services that are the object of these General Terms and Conditions.
7. Applicable law and competent jurisdiction
These Rules of Use are governed by Spanish law. In resolving any disagreement that may arise with regard to the validity, execution, fulfilment of resolution, whether total or partial, Sallés Hotels and Users submit to the competence of the Courts and Tribunals of Girona, expressly renouncing their own jurisdiction or any other which may apply. This contract constitutes the full and integral expression of the agreement between Sallés Hotels and the User and substitutes all previous agreements, commitments, statements or agreements - both written and oral - that may have previously existed between the two.
